1. Notify the Landlord in Advance.Three months prior to the expiration of the lease

Notify the landlord of his intention to refuse the renewal to prevent the contract from being automatically renewed under implied renewal. This prevents the lease from automatically falling under implied renewal, giving both parties clarity about the end of the tenancy. By communicating early, you can avoid misunderstandings and establish a clear timeline for the return of your deposit.

2. Secure Your Rights Through Lease Registration.

If your landlord is unwilling to return the deposit without finding a new tenant, take proactive measures to safeguard your rights. Pursue the lease registration order procedure, which grants you opposing force and preferential payment rights as stated in Article 3 of the Housing Lease Protection Act. These rights are crucial in ensuring you can move out freely while still maintaining a claim to the deposit.

3. Understanding the Housing Lease Protection Act.

The Housing Lease Protection Act in your jurisdiction defines the obligations and rights of both landlords and tenants. According to Article 3-2, the lease relationship is considered ongoing until the deposit is returned, which means you retain your obligations under the lease until then. Therefore, refrain from moving out before receiving the deposit back, as doing so may result in losing your opposing force and preferential payment rights.

4. The Leasehold Registration Order System.

The leasehold registration order system, introduced in March 2023, empowers tenants to relocate freely without waiting for a deposit refund. This system enables you to register your leasehold before informing the landlord, enhancing your flexibility and securing the deposit return bond. However, note that this system usually requires a six-month maintenance period before implementation.

5. How to Apply for a Leasehold Registration Order.

To apply for a leasehold registration order, you do not need the landlord's consent. Submit your application to the district court with jurisdiction over your rental property. Attach relevant documents, including a copy of the lease contract, a certificate of registered matters, and an abstract of resident registration. Pay the required fees, including the service fee, registration fee for lease registration, registration tax, and education tax. Once the court approves the registration, you can take further action if the landlord continues to withhold your deposit.

6. Legal Recourse and Compulsory Auction.

If your landlord still refuses to return the deposit, consider filing a lawsuit to recover the amount. You may apply for a compulsory auction of the real estate after obtaining a judgment. Legal interest may also apply from the registration until the actual repayment, so utilize this option when necessary.
